Abstract:   (11 Views)
In verse 34 of Surah Nisa, the method of dealing with women's problems is described. A group of commentators and jurists have considered Nashuz to be the abandonment of a woman's submissiveness, and the degree of dealing with it is related to the abandonment of submissiveness; This view faces challenges; including the inconsistency with the scope of the meaning of consistency, which is wider than compliance. Also, punishing Tarek Temkin's wife by means of "divorce" cannot be unpleasant for her. From the author's point of view, according to several evidences, including; The dignity of descent, the meaning of Qawamit and its extent, the context of the verse in addition to the context of the Surah, the evidence related to the words of the verse, the division of women into Qant and Nashez against the husband's Qawmiat, the traditions documented in the verse, the traditions that put a man as the guardian of a woman, The narrations that introduce the best and worst women, the narrations condemning men commanding women, and the narrations that extend the beating to non-submissive cases are not extensive beyond leaving submission.
This research tries to prove on the basis of library data and analytical-descriptive approach that the intention of the wife's rebellion, revolt and rebellion against the husband's authority and management, is not just leaving obedience; With this interpretation, the wisdom of the three stages of dealing with wife's divorce in the Holy Quran is clarified.
